1. Introduction

These Terms of Service ("Terms") govern your access to and use of the EndpointAI ("Service"), operated by EndpointAI ("we", "us", or "our"). By creating an account or using our Service, you agree to be bound by these Terms.

2. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, including your password and API keys. You agree to notify us immediately of any unauthorized access to your account.

3. Subscription & Payments

The Service is offered through paid subscription plans. By subscribing, you agree to pay the applicable fees for your chosen plan. Subscriptions are billed monthly and grant access for 30 days from the date of payment. Payments are processed securely through Razorpay. All fees are non-refundable except as described in our Refund Policy.

4. API Usage

Your use of the API is subject to the rate limits and usage caps associated with your subscription plan. You agree not to exceed the limits of your plan or attempt to circumvent any restrictions. We reserve the right to throttle or suspend access if usage patterns indicate abuse or exceed reasonable bounds.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or discriminatory
• Attempt to reverse-engineer, decompile, or extract the underlying models
• Redistribute API access or resell the Service without authorization
• Interfere with or disrupt the integrity or performance of the Service
• Violate any applicable laws or regulations
• Use the Service for spam, phishing, or malware distribution

6. Intellectual Property

You retain ownership of the content you submit through the API ("Input") and the content generated by the API in response ("Output"). We do not claim any rights over your Input or Output. The Service itself, including its design, code, and documentation, remains our intellectual property.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

8. Termination

You may cancel your subscription at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your access to the Service will cease and any remaining subscription period will be forfeited, unless otherwise required by law.

9. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
